A.R.S. § 13-1202 — Threatening or Intimidating


Under A.R.S. § 13-1202, a person commits threatening or intimidating by threatening another person by word or conduct to cause physical injury or serious damage to property.

Penalties

Generally a Class 1 misdemeanor. If committed in connection with criminal street gang activity, it is a Class 6 felony.

Defenses

Common defenses include challenging whether the alleged threat was credible or specific enough to constitute a criminal act, or arguing that the statement was protected speech.
