Kidnapping

Under A.R.S. § 13-1304, a person commits kidnapping by knowingly restraining another person with the intent to hold the victim for ransom or as a hostage, force involuntary servitude, inflict death or physical injury, or interfere with a governmental function.

Penalties

Class 2 felony. Reduced to Class 4 if the victim is released voluntarily without injury. When the victim is under fifteen, enhanced mandatory sentences apply.

Defense

Kidnapping is commonly charged alongside armed robbery, sexual assault, and domestic violence. Even in domestic disputes where one person prevents another from leaving a room, the charge can carry devastating consequences. Experienced defense counsel is essential.
