Representation in criminal cases usually occurs in two phases: the pre-trial phase and the trial phase.

The pre-trial phase begins as early as learning of a criminal allegation, but more often begins at arrest, and continues through the first few months of the case being prosecuted. It is during this time that the case may be resolved through legal attacks resulting in dismissal, or an acceptable plea agreement may be negotiated.

If the case does not resolve at this phase, and a trial date will be set, the trial phase begins. The trial phase involves all aspects of preparing for and going to trial.
