A.R.S. § 13-1406 — Sexual Assault


Under A.R.S. § 13-1406, a person commits sexual assault by intentionally or knowingly engaging in sexual intercourse or oral sexual contact without consent. This is Arizona’s equivalent of rape.

Penalties

Class 2 felony, designated as a dangerous offense with mandatory prison. Presumptive sentence of 7 years with a range of 5.25 to 14 years. Lifetime sex offender registration required.

Defenses

The central issue is usually consent. The defense may also challenge forensic evidence, the credibility of the reporting party, or raise identification issues.
